FAQ
How to change your residential address if your residence card case has been opened?
Updating information in the current case on granting a residence permit in Poland/permanent residence card is an important factor for obtaining a positive decision. In case of a change of address, you are obliged to notify the inspector by sending a relevant information letter or by attaching a new document to the case confirming your right to reside at the new address (e.g. a lease agreement).
I am 17 years old. Can I apply for a residence permit?
Minors can initiate a case for granting a temporary residence permit/permanent residence card only in the presence of one of their parents or a guardian appointed by the court.
Is it possible to submit documents without being in Poland?
No, to initiate a case for granting a residence permit, presence in Poland is mandatory. The exception is cases concerning family reunification, when one family member is outside Poland.
I have no grounds for applying for a residence permit in Poland? What can I do?
There are many reasons for legalization, such as: work, study, business, family, and everyone can choose the one that suits them. If you plan to stay in Poland, then having a reason for staying is mandatory for subsequent legalization.
Is it possible to invest money in Poland or buy a property and thus obtain a residence permit?
There is no such possibility in Poland. Having a home or investment will not help in the matter of legalization in Poland. Having grounds for staying in the country is still a mandatory requirement.
I was refused a residence card. Reasons and what to do?
There can be many reasons for refusal of a residence card. From an inspector’s mistake and an untimely response to a request from the department and errors in documents to fines, administrative and criminal cases in the past. Each negative decision is carefully analyzed and based on it, an appeal is prepared to a higher authority, after which a negative decision can be changed to a positive one.
Is it possible to appeal a positive decision?
Yes, if you are not satisfied with the period of issuance of a residence permit, or other nuances indicated in the decision, a positive decision can also be appealed, observing the deadlines.
I received a residence card, but I want to change my job, what steps should I take?
If your residence permit card was issued with a link to a specific employer, then within 15 days from the date of dismissal you are required to notify the body that issued you the residence permit about your dismissal, and within the next 15 days initiate a case to change your employer, otherwise your residence permit card may be cancelled.
